Chapter 98

א <big><strong>מתני׳</strong></big> נטל ממנה עצים אסורין בהנאה הסיק בהן את התנור אם חדש יותץ ואם ישן יוצן אפה בו את הפת אסורה בהנאה
1 If one took pieces of wood from it [the asherah tree], they are forbidden to be used. If he heated an oven with them— if it was new it must be broken to pieces; if it was old, it must be allowed to cool. If he baked bread [in an oven heated with wood from an asherah], it is forbidden to be used,
ב נתערבה באחרות כולן אסורות בהנאה ר"א אומר יוליך הנאה לים המלח אמרו לו אין פדיון לעבודת כוכבים:
2 and if [the loaf] became mixed with other loaves, they are all prohibited. Rabbi Eliezer says: let him cast the advantage [he derives] into the Dead Sea. They said to him: there is no process of redemption for an idol.
ג נטל הימנה כרכור אסור בהנאה ארג בו את הבגד אסור בהנאה נתערב באחרים ואחרים באחרים כולן אסורין בהנאה ר"א אומר יוליך הנאה לים המלח אמרו לו אין פדיון לעבודת כוכבים:
3 If one took [a piece of wood] from it [to use as] a shuttle, it is forbidden to be used. If he wove a garment with it, it is forbidden to be used. If [the garment) became mixed with others, and these with others, they are all forbidden to be used. Rabbi Eliezer says: let him cast the advantage [he derives] into the Dead Sea. They said to him: there is no process of redemption for an idol.
ד <big><strong>גמ׳</strong></big> וצריכא דאי אשמעינן קמייתא בהא קאמר ר' אליעזר משום דבעידנא דקא גמרה פת קלי לה איסורא אבל כרכור דאיתיה לאיסורא בעיניה אימא מודי לרבנן
4 GEMARA. It was necessary [to mention both cases]; because if he had informed us of only the first [we might have thought] that R. Eliezer spoke of this case only because at the time when the loaf is finished [baking] the prohibited material had been burned; but in the case of the shuttle, since the prohibited objected remains, I might have said that he agrees with the rabbis.
ה ואי אשמעינן כרכור בהא קאמרי רבנן אבל פת אימא מודו ליה לר"א צריכא
5 If he had only informed us of the case of the shuttle, [we might have thought] that the rabbis spoke of this case only, but in the case of a loaf I might have said that they agree with R. Eliezer, that the equivalent of the value of the forbidden loaf or garment can be destroyed. [Therefore both are] necessary.
ו א"ר חייא בריה דרבה בר נחמני אמר רב חסדא אמר זעירי הלכה כר"א איכא דאמרי אמר רב חסדא אמר לי אבא בר רב חסדא הכי אמר זעירי הלכה כר"א
6 R. Hiyya, son of Rabbah b. Nahmani, said in the name of R. Hisda: Ze'iri said that the halackah follows R. Eliezer. There are those who say that R. Hisda said: Abba son of R. Hisda informed me that Ze'iri said: The halakhah follows R. Eliezer.
ז אמר רב אדא בר אהבה לא שנו אלא פת אבל חבית לא ורב חסדא אמר אפילו חבית מותרת
7 R. Adda b. Ahavah said: This was taught only with regard to the loaf, but with regard to a jug [of wine] it was not [taught]. But R. Hisda said: Even a cask of wine is permitted.
ח ההוא גברא דאיתערב ליה חביתא דיין נסך בחמריה אתא לקמיה דרב חסדא אמר שקול ארבע זוזי ושדי בנהרא ונשתרי לך:
8 There was a man for whom a cask of libated wine got mixed up with his own wine. He came before R. Hisda who told him, “Take four zuz and throw them into the river and the wine will then be permitted to you [to dispose of].”
ט <big><strong>מתני׳</strong></big> כיצד מבטלה קירסם וזירד נטל ממנה מקל או שרביט אפי' עלה ה"ז בטלה שיפה לצרכה אסורה שלא לצרכה מותרת:
9 How does one annul [an asherah]? If [a pagan] pruned or trimmed it, removing from it a stick or twig or even a leaf, behold it is annulled. If he smoothed it out for its own sake, it is prohibited; but if not for its own sake, it is permitted.
י <big><strong>גמ׳</strong></big> אותן שפאין מה תהא עליהן פליגי בה רב הונא (ור' חייא) בר רב חד אמר אסורין וחד אמר מותרין
10 GEMARA. The pieces which were smoothed off—what is their status? R. Huna and Hiyya b. Rav differ in opinion. One said that they are prohibited, the other that they are permitted.
יא תניא כמ"ד מותרין דתניא עובד כוכבים ששיפה עבודת כוכבים לצרכו היא ושפאיה מותרין לצרכה היא אסורה ושפאיה מותרין וישראל ששיפה עבודת כוכבים בין לצרכה בין לצרכו היא ושפאיה אסורין
11 It was taught in agreement with the one who said that they are permitted, for it has been taught: If an idolater smoothed off an idol for his own sake, the tree and the pieces are permitted, and if he did so for the tree’s sake, it is prohibited but its pieces are permitted; but if an Israelite smoothed off an idol, whether for his sake or for the sake of the tree it and the pieces are prohibited.
יב איתמר עבודת כוכבים שנשתברה רב אמר צריך לבטל כל קיסם וקיסם ושמואל אמר עבודת כוכבים אינה בטלה אלא דרך גדילתה
12 It has been stated: If an idol was broken of its own accord: Rav said: It is necessary to annul every little pieces; but Shmuel said: An idol is only annulled when it is in its natural form.
יג אדרבה דרך גדילתה מי מבטלא אלא ה"ק אין עבודת כוכבים צריכה לבטל אלא דרך גדילתה
13 On the contrary, does one annul it when it is in its natural form! Rather this is what he means to say: An idol need not be annulled except when it is in its natural form.
יד לימא בהא קמיפלגי דמ"ס עובדין לשברין ומ"ס אין עובדין לשברין
14 Shall we say that they differ on this point: One holds that [idolaters] worship fragments [of idols] and the other holds that they do not worship fragments?
טו לא דכ"ע עובדין לשברין והכא בשברי שברים קמיפלגי מ"ס שברי שברים אסורין ומ"ס שברי שברים מותרין
15 No, they all agree that idolaters worship fragments; and here they differ with respect to the fragments of the fragments. One holds that the fragments of the fragments are prohibited and the other holds that they are permitted.
טז ואיבע"א דכ"ע שברי שברים מותרין והכא בעבודת כוכבי' של חליות ובהדיוט שיכול להחזירה קמיפלגי מ"ס כיון דהדיוט יכול להחזירה לא בטלה ומ"ס אין עבודת כוכבים בטלה אלא דרך גדילתה דהיינו אורחיה הא לאו גדילתה היא ואין צריכה לבטל:
16 Or if you wish, I can say that they all agree that the fragments of the fragments are permitted, and here they differ with respect to an idol which is formed in sections and with regard to an ordinary man who is able to restore it. One holds that since an ordinary man is able to restore it, it is not annulled; while the other holds that an idol need only be annulled when it is in its natural form, that is, the form it normally assumes. So in this instance it is not in its natural form, and there is no need to annul it.

יח מתני׳ <big><strong>רבי</strong></big> ישמעאל אומר שלש אבנים זו בצד זו בצד מרקוליס אסורות ושתים מותרות וחכ"א שנראות עמו אסורות ושאין נראות עמו מותרות:
18 Rabbi Ishmael says: if three stones are lying side by side next to a Merculis (=Mercurius), they are prohibited; if there are two they are permitted. The sages say: if [the stones] are seen to be connected with it they are prohibited, but if they do not appear to be connected with it they are permitted.
יט <big><strong>גמ׳</strong></big> בשלמא רבנן קסברי עובדין לשברים נראות עמו דאיכא למימר מיניה נפל אסורות שאין נראות עמו מותרות
19 GEMARA. The opinion of the rabbis makes sense. They hold that [idolaters] worship the fragments [of idols], [therefore the stones] that are seen with it, we can assume that they fell from it and are prohibited, but if they are not seen with it they are permitted.
כ אלא ר' ישמעאל מאי קסבר אי עובדין לשברין אפילו תרתי נמי ליתסר אי אין עובדין לשברים אפי' תלת נמי לא
20 But what does R. Ishmael hold? If he holds that [idolaters] worship the fragments, then even two stones should be prohibited; and if he holds that they do not worship the fragments, then even three stones should not [be prohibited]!
כא אמר רב יצחק בר יוסף א"ר יוחנן בידוע שנשרו ממנו דברי הכל אסורות ואפילו למ"ד אין עובדין לשברים ה"מ עבודת כוכבים דלאו היינו אורחיה אבל הכא דמעיקרא תבורי מיתברי היינו אורחיה כי פליגי בסתמא
21 R. Yitzchak b. Joseph said in the name of R. Yohanan: If it is known that they fell from the idol, all agree that they are prohibited, and even according to the one who says that they do not worship fragments, this applies only to an idol for which this is not normal. But here [with the Mercurius, the stones are] from the outset detached and that is its normal form. They differ when we do not know [from where they fell].
